Terms of Service
Last updated: September 28, 2026
These Terms of Service (“Terms”) govern your access to and use of KitchenSync, including the web application at app.kitchensync.co, the website at kitchensync.co, and related services (collectively, the “Service”), provided by Missing Piece Tech LLC (“KitchenSync,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a business, you represent that you are authorized to bind that business, and “you” refers to that business.
1. The Service
KitchenSync is software that helps food businesses manage recipes, ingredients and suppliers, estimate the nutrition content of recipes from USDA FoodData Central data and data you enter, generate Nutrition Facts labels, flag likely allergens, and calculate recipe costs from the prices you enter.
2. Eligibility and accounts
You must be at least 18 years old to use the Service. You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity under your account. Tell us promptly at contact@kitchensync.co if you believe your account has been used without your permission.
3. Nutrition labels, allergens and your responsibilities
KitchenSync is a calculation tool, not a regulatory, nutrition, or food-safety authority. Nutrition values, Nutrition Facts labels, % Daily Values, allergen flags, yield estimates and costs are estimates calculated from third-party data (such as the USDA FoodData Central database) and from the recipes, amounts, densities, serving sizes and prices you enter. They can be wrong or incomplete, including because an ingredient is matched to a USDA entry that does not reflect the product you actually use, or because your ingredients, suppliers or processes change.
You are solely responsible for:
- Checking every label, nutrient value and allergen statement before you use it on packaging, in marketing, or anywhere else.
- Complying with all laws and regulations that apply to your food products and their labeling, including U.S. Food and Drug Administration rules, state cottage food laws, and any requirements for nutrient content claims, health claims, and allergen declarations.
- Declaring allergens correctly. Automated allergen detection works from ingredient descriptions and can miss allergens, including those introduced by cross-contact or by sub-ingredients that are not listed.
- The pricing and business decisions you make using cost figures from the Service.
Where accuracy matters for compliance, consider laboratory analysis or review by a qualified professional. Nothing in the Service is legal, regulatory, nutritional, medical or financial advice.
4. Plans, billing and cancellation
The Service offers a free plan and paid subscription plans. Current plans, prices and limits are shown on our pricing page. Paid plans are billed in advance on a recurring monthly basis through our payment processor, Stripe, and renew automatically until you cancel. By subscribing, you authorize us to charge your payment method for each billing period at the then-current price, plus any applicable taxes.
You can cancel at any time from your account’s billing settings. Cancellation takes effect at the end of the current billing period, and your account then moves to the free plan and its limits. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods. If we offer a free trial, you will be charged when the trial ends unless you cancel before then.
We may change our prices or plan limits. We will give you notice before a price increase applies to your subscription, and the change will take effect at the start of your next billing period. If a payment fails, we may suspend paid features until the balance is paid.
5. Your content
You keep ownership of the recipes, ingredients, supplier information, prices, notes, images and other content you add to the Service (“Your Content”). You grant us a limited license to host, store, process and display Your Content only as needed to operate, secure and improve the Service and to provide it to you. We do not claim ownership of your recipes and we do not publish them.
You are responsible for Your Content and represent that you have the rights needed to add it to the Service. We recommend that you keep your own copies of recipes and labels that are important to your business.
6. Third-party data and services
The Service relies on third parties, including the USDA FoodData Central database for nutrition data, Stripe for payments, and the hosting and service providers listed in our Privacy Policy. Third-party data is provided as is, and we are not responsible for its accuracy or for the acts, omissions or availability of third-party services. Your use of them may also be subject to their own terms.
7. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent or unauthorized purpose.
- Interfere with, disrupt, overload, probe or attempt to gain unauthorized access to the Service or other users’ accounts.
- Scrape, copy, resell or sublicense the Service, or reverse engineer it except as the law allows.
- Share your account with people outside your business, or create accounts to evade plan limits.
- Upload content that is unlawful or infringes anyone else’s rights.
8. Intellectual property
The Service, including its software, design and content (other than Your Content and third-party data), is owned by Missing Piece Tech LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. Labels you generate from Your Content are yours to use on your products. If you send us feedback or suggestions, we may use them without obligation to you.
9. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that nutrition values, labels, allergen flags or costs will be accurate or complete.
10. Limitation of liability
To the maximum extent permitted by law, KitchenSync and Missing Piece Tech LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, inventory or goodwill, arising out of or related to your use of the Service. This includes losses arising from product recalls, relabeling, regulatory action, or claims by your customers relating to labels, nutrition information or allergen information. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of the fees you paid us in the twelve months before the event giving rise to the claim or $50.
11. Indemnification
You agree to indemnify and hold harmless KitchenSync and Missing Piece Tech LLC and its officers, employees and agents from any claims, damages, liabilities and expenses (including reasonable attorneys’ fees) arising out of your food products and their labeling, Your Content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
12. Termination
You may stop using the Service at any time, and you may ask us to delete your account by emailing contact@kitchensync.co. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Provisions that by their nature should survive termination, including payment obligations, disclaimers, limitations of liability and indemnification, will survive.
13. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Texas, and you consent to the jurisdiction of those courts.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, notify you by email or in the Service. Your continued use of the Service after changes take effect means you accept the revised Terms.
15. General
These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
